That 8/100 number is a common manufacturer warranty rather than a legal minimum, and a full battery-electric car is covered by whatever its manufacturer promises.

Ask ten EV owners how long their battery is covered and nine will say eight years or a hundred thousand miles, whichever comes first. It is the single most repeated number in electric car ownership. It is also not a law, and in California it is not always the right number.

Here is what California actually puts in writing, where the official paperwork goes quiet, and how long these batteries seem to last in practice.

The number everyone quotes is a promise, not a rule

The U.S. Department of Energy’s Alternative Fuels Data Center puts it plainly: many manufacturers offer 8-year/100,000-mile warranties for their EV batteries. Offer. Not are required to offer.

The same page adds a caveat worth sitting with: comprehensive data on EV battery failures is not available, and if a battery needs replacing outside warranty, it is expected to be a significant expense. Manufacturers generally do not publish replacement pricing.

So the honest version of the 8/100 answer is that it is an industry norm that most automakers converged on, not a floor anyone is holding them to.

What California actually requires

California does mandate warranty periods, through the Air Resources Board, and the numbers are more generous than the industry norm for some vehicles. These are the periods on CARB’s California Vehicle and Emissions Warranty Periods fact sheet, dated March 6, 2026.

Coverage

Applies to

Period

Defects and performance warranty

All emissions related parts, 1990 and newer passenger cars and light trucks

3 years / 50,000 miles

High-cost emissions-related parts

Specific high-cost parts listed in your owner’s manual

7 years / 70,000 miles

Enhanced warranty, PZEV and TZEV

Vehicles certified to the 2001 to 2017 PZEV standard or the 2018 to 2025 TZEV standard, emissions parts other than the battery

15 years / 150,000 miles

PZEV and TZEV battery

The battery or other energy storage device on those same vehicles

10 years / 150,000 miles

Federal basic emissions warranty

1995 and newer vehicles, any part causing an emissions failure

2 years / 24,000 miles

Federal extended coverage

Catalytic converter, emissions control unit, onboard diagnostic computer

8 years / 80,000 miles

Look at the fourth row again. 10 years and 150,000 miles on the battery, referenced to Title 13 California Code of Regulations section 1962. That is two more years and fifty thousand more miles than the number most owners believe they have.

TZEV is the category most plug-in hybrids sold in California fall into. If you drive a plug-in hybrid bought new in California in the last several years, there is a real chance your battery coverage is longer than the sticker in your memory. CARB’s own advice, printed at the top of the fact sheet, is the right next step: check your vehicle’s owner’s manual for the specific coverage, since certification varies by model.

The gap: CARB’s fact sheet has no row for a full electric car

Now the part that surprised us while verifying this.

CARB’s warranty fact sheet has tables for 1990 and newer passenger cars, for motorcycles, for diesel heavy-duty vehicles, and for gasoline heavy-duty vehicles. It has a dedicated row for PZEV and TZEV battery coverage.

It has no row at all for a battery-electric vehicle. A driver with a full EV who goes to the state’s own emissions warranty fact sheet looking for their battery coverage will not find their vehicle on it.

That does not mean a full EV is uncovered. It means the answer for a BEV lives in the manufacturer’s warranty booklet rather than on the state fact sheet where a reasonable person would go looking. If you own one, the document that governs your battery is the one in your glovebox, and it is worth actually reading the capacity-retention language in it. Most battery warranties cover capacity loss only below a stated threshold, not any loss at all.

So how long do these batteries actually last?

Warranty length and service life are different questions, and the second one has a published answer.

Predictive modeling cited by the Alternative Fuels Data Center indicates that today’s batteries may last 12 to 15 years in moderate climates, and 8 to 12 years in extreme climates. Beyond climate, the factors that move the number are driving and charging patterns, cell chemistry and design, and how well the pack’s thermal system is engineered.

Two honest caveats belong with that range. First, it is modeling rather than a survey of failures, and the underlying Department of Energy report it points to is now over a decade old, which is several generations of battery chemistry ago. Second, California contains both ends of that range. A car that lives in Fremont or along the coast is in about as moderate a climate as the model contemplates. A car that spends its summers in Bakersfield, Redding, or the low desert is not.

The practical read: for most California drivers, the battery is likely to outlast the warranty, and probably by years. That is the opposite of the fear most prospective EV buyers carry into the showroom.

What a fading battery does to your DMV registration

Nothing. There is no California registration consequence to reduced battery capacity, no state-run battery inspection, and no capacity threshold tied to renewal.

What does not change is the bill. Every model year 2020 and later zero emission vehicle pays a Road Improvement Fee of $121 at renewal under Vehicle Code 9250.6, per DMV’s registration fees page updated June 30, 2026. There is one quirk worth knowing: the RIF is not assessed on the initial registration of a newly purchased ZEV from a licensed dealer, which is exactly why so many new EV owners get blindsided by it a full year after buying the car.

On top of that sits the $76 registration fee, the Transportation Improvement Fee tied to your vehicle’s value, and the vehicle license fee at 0.65% of value. If you want the fuller picture of where EV road funding is heading in this state, we covered the California road charge and whether EVs will be taxed per mile in detail.

Frequently asked questions

Is the 8-year, 100,000-mile EV battery warranty required by law?

No. The U.S. Department of Energy’s Alternative Fuels Data Center describes it as a warranty many manufacturers offer, not a mandated minimum. California does set warranty periods through the Air Resources Board, and for vehicles certified to the PZEV or TZEV standard the battery or other energy storage device is covered for 10 years or 150,000 miles.

How long does an electric car battery last?

Predictive modeling cited by the Alternative Fuels Data Center puts today’s batteries at 12 to 15 years in moderate climates and 8 to 12 years in extreme climates. Driving and charging patterns, cell chemistry, and the pack’s thermal management also matter. Coastal California sits at the favorable end of that range and the inland valleys and deserts at the harsher end.

Does a worn EV battery affect my California registration?

No. California does not inspect battery capacity or tie registration renewal to battery health. Model year 2020 and later zero emission vehicles still owe the $121 Road Improvement Fee at renewal under Vehicle Code 9250.6, regardless of how much range the pack has left.

One less thing to think about

Your battery will most likely be fine. Your renewal notice still shows up every year, still wants the $121 Road Improvement Fee on top of everything else, and still does not care how your car is powered.

Sticker Quicker is a licensed California DMV Business Partner, DMV Occupational License #90656, with DMV-connected real time processing.
