You may use one hands-free, mounted on the windshield, dashboard or center console where it does not block your view, and you may give it a single swipe or touch. Drivers under 18 may not use a phone at all, except to call for emergency help.

Everybody knows the hands-free law. Almost nobody can tell you where the line actually sits. Is a quick tap to skip a song legal? What about holding the phone up to read a map at a red light? Can you mount it anywhere you like?

Here is the frustrating part: California has three separate state pages describing this law, and they do not give the same answer. One of them says you may touch a mounted phone once. Another says using maps and music is illegal. And not one current state page tells you what the ticket costs or whether it puts a point on your record. So this piece does what those pages do not: it names each source, dates it, and tells you which one to trust.

The only rule that never bends: your hand

Strip away the detail and California’s law is about one thing. The phone cannot be in your hand. The California Highway Patrol put it plainly on April 9, 2026: drivers may not hold or use a cellphone while driving unless the device allows hands-free, voice-operated use. If you cannot do that, the CHP says, dial 9-1-1 if it is an emergency, ask a passenger, or pull over safely first.

That is why the law survives every new phone feature. It does not regulate apps. It regulates your hand.

Definition: what “hands-free” actually means

Hands-free means the phone is operated by voice or by a mounted interface while it rests in a holder, not in your grip or your lap. Speakerphone, voice commands and steering-wheel controls all qualify. Holding the phone to your ear qualifies for nothing, and neither does holding it low in your lap where you think an officer cannot see it.

Where you are allowed to mount it

This is the part most drivers have never read. The California Driver Handbook, Section 8, Safe Driving, last updated December 2, 2025, names the permitted locations and the permitted gesture:

Mount the phone on the windshield, the dashboard or the center console.

It must not block your view of the road.

Use only a single swipe or touch on the mounted phone.

So the handbook does not ban every interaction. It budgets you exactly one. If changing a destination takes four taps, those extra three are where the trouble starts. And the mounting rule is its own separate body of California law: there are measured zones on the glass where a device may legally sit, which we broke down in California’s windshield mounting law.

Two state pages, two answers, on the same tap

Here is the conflict, and it is worth knowing which side you are standing on.

The DMV handbook (updated December 2, 2025) allows a single swipe or touch on a mounted phone. The California Office of Traffic Safety distracted driving page says apps, music, videos, social media, maps and photos are “all distracting and illegal to use while driving,” and it carries no update date at all.

Both are state surfaces. They do not agree. The sensible read: the DMV handbook is the dated document, it is the one tied to the driver licensing system, and it is the one that describes the single-touch allowance. The OTS page is a safety campaign, and a campaign is written to discourage, not to define. Treat the handbook as the legal line and the OTS page as the advice your insurer would give you.

The roadside version of that: one touch on a mounted phone is defensible. A sequence of taps is not, and no page anywhere promises an officer will count them in your favor.

What it costs, and the number the state does not print

This is the cleanest gap in the whole topic. Not one current DMV or OTS page gives a dollar figure for a handheld violation.

The only state-published number sits on a CHP distracted driving handout, which lists a minimum of $162 for a first texting or cell phone citation and says fines increase with each later violation without naming the later amounts. That handout is undated, which is why the figure deserves a caveat rather than a headline. Your actual bill is set by your county court, which adds assessments on top of the base amount, so two drivers cited on the same freeway in different counties do not pay the same total.

The CHP handout also cites the code sections the citation is written under: CVC 23123(a) for talking on a non-hands-free phone at 18 and over, CVC 23123.5(a) for texting, and CVC 23124(b) for any phone use by a driver under 18.

And the point question, answered honestly

Whether a hands-free violation adds a point to your record is not stated on any current DMV page we could verify, so we are not going to tell you either way. What the DMV does publish is exactly what a point costs you. From the DMV’s Negligent Operator Actions page (updated May 19, 2023):

Level

What happens

Point thresholds

Level I

Warning letter

2 points in 12 months, 4 in 24, or 6 in 36

Level II

Notice of intent to suspend

3 points in 12 months, 5 in 24, or 7 in 36

Level III

Probation or suspension

4 points in 12 months, 6 in 24, or 8 in 36

The Driver Handbook, Section 7, updated April 13, 2026, confirms the suspension line at 4 points in 12 months, 6 in 24 and 8 in 36, and adds something useful: for a one-point violation a judge may offer traffic violator school once in any 18-month period. Completing it keeps the citation off your insurance report, though it stays on your driving record.

Drivers under 18 get no allowance at all

There is no single-touch rule for minors. The Driver Handbook is flat about it: a driver under 18 may not use a cell phone or other electronic wireless device to answer calls or send or respond to texts while driving. The one exception is a call for emergency assistance. OTS states it even more broadly: any driver under 18 is prohibited from using a cell phone for any reason.

Parents of provisional drivers, that is the line worth repeating at the kitchen table. Hands-free is not a loophole for a 17-year-old.

Enforcement is climbing while the law stands still

The statute has not changed recently. The pressure has. According to the CHP’s April 9, 2026 release:

CHP officers issued more than 111,700 distracted driving citations in 2025, nearly 20% more than in 2024.

Between 2020 and 2025, distracted driving was reported in more than 3,400 California crashes, injuring more than 1,600 people, per state collision data.

Nationally in 2023, federal data counted 3,275 deaths and nearly 325,000 injuries in distraction-related crashes.

7% of drivers aged 15 to 20 involved in fatal crashes were distracted, the highest share of any age group.

The CHP handout adds the physics. Reading or sending a text takes an average of 4.6 seconds, which at 65 mph covers roughly 100 yards with your eyes off the road. It puts the collision risk increase from phone use at 400%. Most collisions, it notes, happen in under three seconds.

Legal or not: the quick table

What you are doing

Driver 18 or over

Driver under 18

Phone to your ear

Not allowed

Not allowed

Speakerphone or voice commands, phone mounted

Allowed

Not allowed

One swipe or touch on a mounted phone

Allowed per the Driver Handbook

Not allowed

Several taps to set a destination while moving

Beyond the single-touch allowance

Not allowed

Texting, reading email

Not allowed

Not allowed

Phone held in your lap, screen up

Not allowed, it is still in your hand

Not allowed

Calling 9-1-1 or another emergency service

Allowed

Allowed

Phone mounted where it blocks your view

Not allowed

Not allowed

The ticket you actually control

Here is an honest distinction. A hands-free citation is a moving violation. It will not stop you from renewing your registration, and it is decided between you, an officer and a county court.

An expired registration sticker is different. It is visible from behind your car at a stoplight, it is its own citation, and unlike a split-second judgment call about a phone tap, it is entirely within your control. If you have been meaning to deal with your tags, that is a ten-minute job, not a DMV field office afternoon.

Sticker Quicker is a licensed California DMV Business Partner, DMV Occupational License #90656, with DMV-connected real-time processing and next-day FedEx delivery of your documents and stickers. One fewer thing an officer can see from the car behind you.

Frequently asked questions

Can I touch my phone at all while driving in California?

Yes, once. The California Driver Handbook, updated December 2, 2025, allows a single swipe or touch on a phone mounted to the windshield, dashboard or center console, as long as it does not block your view. Anything beyond one gesture goes past what the handbook describes, and holding the phone is never allowed.

Is it legal to use maps or music apps while driving in California?

The state is not consistent here. The DMV handbook permits a single swipe or touch on a mounted phone, which covers a one-tap interaction with maps or music. The Office of Traffic Safety page calls app, map and music use while driving illegal. The handbook is the dated, licensing-linked document, so treat one touch as the defensible limit.

How much is a hands-free ticket in California?

No current DMV or OTS page publishes a figure. A CHP distracted driving handout lists a minimum of $162 for a first texting or cell phone citation, with higher amounts for later violations, and that handout is undated. Your county court sets the final total by adding assessments to the base amount.

Does a cell phone ticket add a point to my California record?

No current DMV page we could verify states whether this violation carries a point, so we will not guess. What the DMV does publish is the consequence of points: a warning letter at 2 points in 12 months, and possible suspension at 4 points in 12 months, 6 in 24 or 8 in 36.

Can a 17-year-old use a hands-free phone in California?

No. Drivers under 18 get no hands-free allowance. The Driver Handbook prohibits a minor from using a cell phone or other electronic wireless device to answer calls or send or respond to texts while driving, with the single exception of a call for emergency assistance.

Where can I legally mount my phone in California?

The windshield, the dashboard or the center console, in a position that does not block your view of the road, per the California Driver Handbook. California also sets measured zones on the windshield glass itself, which is a separate rule worth checking before you stick a mount in the middle of your sightline.

Primary sources

California DMV, California Driver Handbook, Section 8: Safe Driving (continued), updated December 2, 2025

California DMV, California Driver Handbook, Section 7: Laws and Rules of the Road (continued), updated April 13, 2026

California DMV, Negligent Operator Actions, updated May 19, 2023

California Highway Patrol, news release on the hands-free law, April 9, 2026

California Highway Patrol, Distracted Driving handout (undated), for CVC 23123(a), 23123.5(a) and 23124(b), the $162 minimum and the collision statistics

California Office of Traffic Safety, Distracted Driving (undated)

Related reading

California school bus law: when you must stop

California windshield law: what you can mount where

California minimum car insurance: what 30/60/15 means

About the author

Mo G is the founder of Sticker Quicker, a licensed California DMV Business Partner with full online access and DMV Occupational License #90656.
