Half the drivers around you think that rider just broke the law. The other half are pretty sure it is legal but could not tell you why. Both groups are closer to right than they realize, because California’s lane splitting law is one of the strangest pieces of writing in the Vehicle Code.

The short answer

Lane splitting is legal in California, and the CHP says so plainly. What surprises people is that the statute itself, Vehicle Code section 21658.1, contains no permission and no prohibition. It defines lane splitting and authorizes the CHP to publish safety guidelines. That is all it does, which is why different state agencies describe the same practice in different words.

What lane splitting actually means

Lane splitting: riding a two-wheeled motorcycle between rows of stopped or moving vehicles traveling in the same direction, in the same lane, on a divided or undivided road. That is the definition the CHP uses, drawn from Vehicle Code section 21658.1, which took effect January 1, 2017.

You will also hear it called lane sharing or filtering. California’s DMV treats those as names for the same maneuver. Two details inside the definition do real work:

Two wheels. The definition covers a motorcycle with two wheels in contact with the ground. A trike is not doing this.

Same direction, same lane. Splitting is movement between rows of traffic going your way, not across oncoming lanes.

And one thing that is not lane splitting, which the CHP calls out specifically: riding on the shoulder. The CHP states that riding on the shoulder is illegal and is not considered lane splitting. People conflate the two constantly, usually right before arguing about it online.

Why the law reads so oddly

Before 2017, California neither permitted nor banned the practice. It simply was not addressed. Assembly Bill 51, Chapter 141, was approved by the Governor and filed with the Secretary of State on August 19, 2016, and it added section 21658.1 to the Vehicle Code. The new section did three things:

Defined lane splitting.

Authorized the CHP to develop educational guidelines promoting the safety of the motorcyclist and of the drivers and passengers around them.

Required the CHP, in developing those guidelines, to consult the DMV, Caltrans, the Office of Traffic Safety, and a motorcycle organization focused on rider safety.

Notice what is missing. The Legislature did not write “a motorcyclist may lane split.” It wrote a definition and a homework assignment. California moved lane splitting out of the legal gray zone by naming it, not by granting permission, and the practical effect is that it is legal because nothing prohibits it and the state’s traffic safety agency openly treats it as lawful.

The state’s own pages do not agree with each other

This is not an abstract point. Three official California pages describe the same law three ways, and anyone researching this topic will hit all three.

Official source

How it describes lane splitting

Last modified

CHP, California Motorcyclist Safety

States lane splitting is legal in California and gives safety guidance

Current program page

DMV, California Driver Handbook, Laws and Rules of the Road

“It is legal to share lanes with motorcycles, this is known as lane splitting.”

June 11, 2025

DMV, Motorcyclists Guide

Says California law “does not allow or prohibit motorcycles from passing other vehicles” in the same lane

October 21, 2025

Look at the dates. The page that still uses the pre-2017 framing is the DMV’s guide written for motorcyclists, and it is the more recently updated of the two DMV pages. The riders who most need a clear answer are being handed the vaguest one. None of the three is wrong, exactly. They are describing a statute that genuinely contains a definition and nothing else.

What the CHP actually tells riders

The CHP’s published guidance is about managing risk, not about clearing a legal bar. Its core points:

Danger rises with your overall speed and with the speed difference between you and surrounding traffic. Both numbers matter, independently.

Splitting between the two far-left lanes is typically safer than splitting between other lanes.

Avoid splitting alongside large vehicles such as trucks, buses, and motorhomes.

Stay out of other drivers’ blind spots, and linger in them as briefly as possible.

Wear bright or reflective gear and use high beams in daylight so you are seen earlier.

Lane splitting is not for inexperienced riders. Every rider owns the decision.

Here is the omission worth naming. You have probably seen two numbers quoted as California rules: split no more than 10 mph faster than traffic, and never above 30 mph. Those figures do not appear anywhere in the CHP’s current published guidance. There is no speed limit specific to lane splitting in California. The ordinary speed laws still apply, and the CHP frames the rest as judgment rather than a number. If you see those figures presented as the law, the source is out of date.

What the law asks of drivers

Lane splitting is not a motorcycle-only subject. The DMV’s driver handbook is direct about what you owe a rider:

Give a motorcycle the full lane whenever possible.

Never try to pass a motorcycle in your own lane.

When possible, move to one side of your lane to give a motorcyclist room to pass.

Allow a safe three-second following distance.

Check for motorcyclists before opening your door next to traffic.

The CHP adds the part that sometimes gets drivers into real trouble: intentionally blocking or impeding a motorcyclist in a way that could cause harm is illegal. Drifting toward the line to make a point is not a traffic philosophy. It is a maneuver with legal exposure. The CHP also suggests that drivers in the far-left lane move left within that lane to open the gap.

The numbers behind the caution

California’s motorcycle safety picture improved in the most recent year the Office of Traffic Safety reports. Motorcyclist fatalities fell 10.2%, from 649 in 2022 to 583 in 2023. Deaths of motorcyclists not wearing a helmet fell about 23.3%, from 43 to 33. Overall California traffic deaths dropped nearly 11% across the same period, from 4,539 to 4,061.

Better, and still 583 people. The CHP’s guidance reads the way it does for a reason.

Frequently asked questions

Is lane splitting legal in California?

Yes. The California Highway Patrol states that lane splitting is legal in California, and Vehicle Code section 21658.1, effective January 1, 2017, defines the practice. The statute itself contains no express permission or prohibition. It defines lane splitting and authorizes the CHP to publish safety guidelines.

Is there a speed limit for lane splitting in California?

No speed limit specific to lane splitting appears in California law or in the CHP’s current published guidance. The often-quoted 10 mph differential and 30 mph ceiling are not in that guidance. Ordinary speed laws still apply, and the CHP advises that risk rises with both your speed and the speed difference with traffic.

Can motorcycles ride on the shoulder in California?

No. The CHP states that riding on the shoulder is illegal and is not considered lane splitting. Lane splitting means riding between rows of vehicles traveling in the same direction within the same lane, not along the shoulder or the breakdown lane.

Can a driver block a lane-splitting motorcycle?

No. The CHP states that intentionally blocking or impeding a motorcyclist in a way that could cause harm is illegal. The DMV’s driver handbook tells drivers to give motorcycles the full lane, never pass one in the same lane, and move to one side of the lane where possible to give a rider room.

Does lane splitting apply to three-wheeled motorcycles?

The definition in Vehicle Code section 21658.1 covers a motorcycle with two wheels in contact with the ground. Three-wheeled motorcycles and trikes fall outside that definition.

Before your next ride

Splitting legally does not help much if your tags are expired, because that is a stop any officer can make on sight.
