AB 390 expanded it from emergency vehicles, tow trucks and road work vehicles to any stationary vehicle displaying flashing hazard lights or another warning device. If you cannot safely change lanes, you must slow to a speed that is reasonable for conditions. Caltrans says it now applies to any motorist in distress.

The law stopped being about emergency vehicles

You already know the move over reflex. Flashing lights on the shoulder, you ease left, you slow down, you go on with your day. Most California drivers learned it as a courtesy to the CHP and to tow operators, and for sixteen years that is roughly what the statute said.

Vehicle Code section 21809(a) took effect on January 1, 2010, and in its original form it covered a driver on a freeway approaching an emergency response vehicle displaying emergency or flashing lights. Narrow and specific. Caltrans was still publishing that framing in its own field material as recently as 2019.

Then AB 390, by Assemblymember Wilson, took effect on January 1, 2026. The CHP’s own description of it is short enough to quote: the bill “expands the ‘slow down and move over’ law to include any highway maintenance vehicle or stationary vehicle,” and “drivers approaching such a vehicle must move into a lane that is not next to the stopped vehicle.” The DMV’s version adds the operative detail: the expansion covers “marked highway maintenance vehicles and those displaying flashing hazard lights or another warning device.”

Caltrans puts it in the plainest terms of the three. The law, it says, now applies to any motorist in distress with warning lights or devices.

Read that again as a driver. The stranger’s sedan on the shoulder with its hazards blinking and a guy crouched at the rear tire now carries the same legal duty you always gave the CHP cruiser. So does the car with a flare set out behind it. So does the marked Caltrans truck with amber lights. There is no “emergency personnel only” qualifier left in it.

Two different laws, and people mix them up constantly

Definition, stationary vehicles (the move over law). A vehicle stopped on or beside the road with warning lights or devices showing. Your duty: change lanes away from it if you safely can, and slow down if you cannot. This is the law AB 390 expanded.

Definition, moving emergency vehicles (the pull over rule). An emergency vehicle coming up behind or toward you with siren and lights active. Your duty: pull to the right edge of the road and stop until it passes. Different situation, different rule, unchanged by AB 390.

If you only remember one distinction from this article, make it that one. Pulling over and stopping for a stationary tow truck on the shoulder is not what the law asks for and can create its own hazard. Moving over and slowing is.

What changed, side by side

Situation on the shoulder

Before January 1, 2026

Now

CHP or other emergency vehicle, lights on

Covered

Covered

Tow truck, amber lights

Covered

Covered

Marked Caltrans or road work vehicle, amber lights

Covered in practice, named in the handbook

Covered, and named explicitly in AB 390

A stranger’s car with hazard lights flashing

Not covered

Covered

A stopped vehicle with flares or cones set out

Not covered

Covered

Officer actively directing traffic

Lane change not required

Lane change not required

Stopped vehicle behind a protective physical barrier

Generally does not apply

Generally does not apply, approach with caution

The DMV handbook still teaches the old version

Here is the part worth knowing if you are studying for a permit test or checking your memory against an official source. The California Driver Handbook still describes the narrow, pre-2026 law.

Its laws and rules section names exactly two categories: “stationary emergency vehicles or tow trucks displaying flashing amber warning lights,” and “stopped road work vehicles displaying emergency flashing or amber warning lights.” A stranger’s disabled car with hazards on appears nowhere. The handbook pages carrying that language were last modified June 11, 2025, which is before AB 390 was signed in August 2025 and roughly seven months before it took effect.

So the state’s own study material is currently teaching a scope the state’s own law no longer has. Both DMV press material and the CHP’s new-laws release describe the expansion correctly. The handbook has not been revised to match. That is not a conspiracy, it is a publication lag, and it is the kind of lag that produces a driver who is confidently wrong.

Worth noting alongside this: California’s official pages are inconsistent on other traffic rules too. We found the same pattern with lane splitting, where three official pages describe one law three ways. When an official page and a newer official page disagree, the newer one and the bill text win.

The statute number almost nobody official will give you

A small oddity, and a useful one if you ever have to look this up. Of the official California pages that describe this duty, none of the current ones cite the Vehicle Code section. Not the DMV handbook’s two relevant pages, not Caltrans’s own Move Over campaign page, not the CHP’s 2026 new-laws release, not the DMV’s 2026 new-laws release. Caltrans’s campaign page references the DMV handbook instead.

The only official California document we could reach that names the section outright is a Caltrans snow-operations flyer, which states that CVC 21809(a) took effect January 1, 2010. That is the number. If you need the current statutory text, go to the California Legislative Information site rather than trusting a summary, because summaries are exactly what got the handbook stuck in 2025.

Why the legislature kept widening it

The numbers behind this law are not abstract. Caltrans reports that 195 of its employees have been killed on the job since 1921, and the agency names inattentive and distracted motorists as one of the biggest hazards its crews face.

2026 has been a bad year specifically. In an October 8, 2026 release, Caltrans said six highway workers, all contractor employees, had been killed in California work zones since August 10, 2026. Three of them died in a single incident on September 25, 2026, in Riverside County. Six deaths in under two months is what an urgent safety call looks like from the inside.

AB 390 was not the only 2026 change aimed at this problem. AB 289 authorized a Caltrans work zone speed safety pilot using radar or laser detection and license plate photographs, with citations issued to registered owners, and AB 1014 let Caltrans drop a highway speed limit by 5 mph with 30 days of warning citations first. The direction of travel is clear: slower around stopped vehicles and work zones, enforced more automatically.

What to actually do when you see hazards ahead

Spot it early and check your mirror, not your brakes. The lane change is the preferred response, and it needs room you can only get by looking ahead.

Move one lane away if it is safe and lawful. On a freeway, that means a lane not immediately adjacent to the stopped vehicle, traffic permitting.

If you cannot change lanes, slow down meaningfully. The standard is a reasonable and prudent speed for the weather, road and traffic conditions. Holding 70 in the lane beside a stopped car is not it.

Do not stop, and do not swerve late. A hard brake or a last-second lane change in heavy traffic creates the secondary collision the law exists to prevent.

Treat an unmarked disabled car exactly like a patrol car. Since January 1, 2026, the law does not distinguish between them.

One practical note on the enforcement side. A move over violation is the kind of stop where an officer is already behind you with your plate on screen. Anything else out of order comes up in the same conversation, and expired tags are the most common of those. We wrote about the towing speed limit and the school bus stop law for the same reason: these are rules enforced on sight.

Frequently asked questions

What is California’s move over law in 2026?

California’s move over law requires a driver approaching a stationary vehicle that is displaying flashing hazard lights or another warning device to change into a lane not immediately next to it when safe and lawful, or to slow to a reasonable and prudent speed if a lane change is not possible. AB 390 expanded it effective January 1, 2026.

Does the move over law apply to regular cars with hazard lights on?

Yes, as of January 1, 2026. AB 390 expanded the law to cover any stationary vehicle displaying flashing hazard lights or another warning device, and Caltrans states it now applies to any motorist in distress with warning lights or devices. Before 2026 it was limited to emergency vehicles, tow trucks and road work vehicles.

Do I have to change lanes or can I just slow down?

Change lanes if you safely and lawfully can. That is the primary requirement. Slowing to a reasonable and prudent speed for conditions is the fallback when a lane change is unsafe or impracticable. Caltrans also notes the lane change is not required where an officer is directing traffic.

What Vehicle Code section is the move over law?

Vehicle Code section 21809, which took effect January 1, 2010, as confirmed in Caltrans field material. Most current official California pages describing the duty, including the DMV Driver Handbook and the Caltrans Move Over campaign page, do not cite the section number at all.

Why does the DMV handbook not mention disabled cars?

The relevant California Driver Handbook pages were last modified June 11, 2025, before AB 390 was signed and about seven months before it took effect. They still name only emergency vehicles, tow trucks and road work vehicles. DMV and CHP press material describes the expansion correctly, so use those for the current scope.

Keep the easy things off your record

The move over law is not a hard rule to follow. Look ahead, give the shoulder a lane, slow down if you cannot. The only genuinely new part is that the car deserving that space might be a neighbor with a flat rather than a CHP unit, and since January 1, 2026 the law does not care which.

What you control completely is whether a roadside stop turns into a second problem.
