Reasonable conclusion. It was in the headlines, the bill number was right there, and the law really did take effect on January 1, 2026.

It just did not do the thing everyone said it did. Not yet, and not for another five years.

The short answer

California’s school zone speed limit is still 25 miles per hour when children are present, not 20. AB 382 took effect on January 1, 2026, but what it did that day was give cities and counties the option to post 20 mile-per-hour school zones. The statewide drop to 20 does not happen until January 1, 2031.

What AB 382 actually did on January 1, 2026

AB 382 (Berman) is real, it is in force, and both state agencies that explain it describe it the same way.

The California Highway Patrol’s New Year, New Laws release of December 26, 2025 states that AB 382 allows local authorities to lower the school zone speed limit from 25 to 20 miles per hour through January 1, 2031, and that after that date the limit will automatically decrease from 25 to 20 in school zones where proper signage is posted.

The DMV’s own New Laws in 2026 roundup, published the same day, lists AB 382 as lowering the school zone speed limit from 25 to 20 miles per hour beginning January 1, 2031.

So the 2026 change was an authorization, not a speed limit. A city that wants 20 can do it now. A city that does nothing keeps 25 until the statewide switch flips in 2031.

That distinction matters in practice, because it means the answer to “what is the school zone speed limit here” is now genuinely local. The same drive across two city lines can pass three different posted limits, all of them lawful.

What applies today: 25 miles per hour, 500 feet, children present

A school zone, for speed limit purposes, is an area of highway within 500 feet of school grounds in any direction, marked with the appropriate signs, unless otherwise posted.

The default limit in that zone is a prima facie 25 miles per hour under Vehicle Code section 22352, and it applies when children are present. It is not a 24-hour limit on an empty street at midnight. It also does not wait for school to be in session when children are out there.

Prima facie means the posted figure is the presumed lawful maximum. You can be cited for exceeding it, and the burden shifts to you to show your speed was safe. It is not an absolute limit in the way the 65 on a freeway is, but treating it as one is the only sensible way to drive it.

There is also a flashing-beacon rule worth knowing: where flashing beacons are in use at a school zone, the school zone limit is in effect while they are flashing.

The 15 mile-per-hour school zone almost nobody knows about

Here is the part that gets lost in the 25-versus-20 argument entirely. California has let local authorities post school zones below 20 for years.

Under Vehicle Code section 22358.4, a local authority may set a prima facie limit of 25 or 15 miles per hour in a residence district on a highway 500 to 1,000 feet from a school, when children are present. Within 500 feet, a 15 mile-per-hour limit is permitted. The conditions are specific: the roadway can have no more than two traffic lanes, and the posted limit immediately before and after the school zone can be no more than 30 miles per hour.

So a driver who believes “school zones are 25” can be wrong in both directions. There are 15 mile-per-hour school zones in California today, posted lawfully, and there is nothing new about them.

What the limit is, and when

Situation

Limit

Authority

In force

School zone, no local ordinance, children present

25 mph

VEH 22352

Now

School zone where a city or county has posted the lower limit

20 mph

AB 382 local option

Now, where posted

Residence district within 500 feet of a school, two lanes or fewer, 30 mph or less on approach

15 mph, where posted

VEH 22358.4

Already in force

Residence district 500 to 1,000 feet from a school, same conditions

25 or 15 mph, where posted

VEH 22358.4

Already in force

School zone, statewide default, signage posted

20 mph

AB 382

January 1, 2031

Any school zone while flashing beacons are in use

School zone limit applies

School zone rules

Now

The date already moved once

The five-year runway was not the original plan. The Assembly Transportation Committee’s analysis of AB 382 as amended April 7, 2025 describes a statewide 20 mile-per-hour school zone limit beginning January 1, 2029, with the local option running until that same date.

The enacted law, as both the DMV and the CHP describe it, sets the statewide date at January 1, 2031. The deadline slipped two years somewhere between that April committee hearing and the bill reaching the Governor’s desk, which is ordinary legislative life. It is also a reason to check the date on any summary written before the bill was signed.

Worth noting what the same committee analysis flagged at the time: the “children are present” standard is broad. It reaches any child on a roadway, sidewalk, pathway or road shoulder within the marked zone, in any direction, and the committee observed that drivers would be left judging the age of people near a school at any hour. Children separated from the highway by a fence, gate or other physical barrier do not count.

The agencies got this right. The coverage did not.

This is the unusual case where the state’s own publications are clearer than the reporting about them. Both the DMV roundup and the CHP release name the 2031 date and describe the 2026 change as a local authorization. Neither says school zones became 20 miles per hour in 2026.

If you want to know what the limit is on a particular street, the answer is not in a news article and it is not in a bill summary. It is on the sign. Which, for the next five years, is the whole point: AB 382 made the sign the authority, because the sign is the only thing that tells you whether your city took the option.

How to drive it

Read the posted school zone sign. It may say 25, 20 or 15, and all three can be lawful in 2026.

Assume children are present if you can see any. The standard does not wait for the school bell, and it is not limited to the sidewalk in front of the building.

Slow for flashing beacons regardless of the time of day.

Expect the limit to change under you in 2031, when the statewide default drops to 20 where signage is posted, with no action needed from your city.

Specific fine amounts for a school zone speeding violation are not quoted here, because the statewide bail and penalty schedule entry for this offense could not be verified at the time of writing. Penalties vary by county and by how far over the limit you were. The California Courts publish the uniform bail and penalty schedules each county uses.

One small thing while you are thinking about what the officer at the school crosswalk can see: a school zone stop is also one of the few moments somebody looks closely at the front of your car. Expired tags are a lot easier to fix in advance than to explain on the spot.

Frequently asked questions

Is the California school zone speed limit 20 mph in 2026?

Not by default. The statewide school zone limit remains a prima facie 25 miles per hour when children are present. AB 382 gave cities and counties the option to post 20 miles per hour starting January 1, 2026, so 20 applies only where a local authority has posted it. The statewide drop to 20 begins January 1, 2031.

When does California’s 20 mph school zone law take effect?

January 1, 2031. Per the California DMV’s 2026 new-laws roundup, AB 382 lowers the school zone speed limit from 25 to 20 miles per hour beginning January 1, 2031. The CHP states that after that date the limit decreases automatically in school zones where proper signage is posted.

How big is a California school zone?

A school zone for speed limit purposes is the area of a highway within 500 feet of school grounds in any direction, unless otherwise posted, and marked with the appropriate signs. Local authorities have separate authority to post reduced limits on highways 500 to 1,000 feet from a school in a residence district.

Can a California school zone be 15 mph?

Yes. Vehicle Code section 22358.4 lets a local authority post a 15 mile-per-hour prima facie limit within 500 feet of a school in a residence district when children are present, provided the roadway has no more than two traffic lanes and the posted limit immediately before and after the zone is no more than 30 miles per hour.

Does the school zone speed limit apply when school is closed?

The 25 mile-per-hour school zone limit under Vehicle Code section 22352 applies when children are present, which is a condition about children rather than about school hours. Where flashing beacons are in use, the school zone limit is in effect while they flash.

Primary sources

California DMV, DMV Highlights New Laws in 2026, published December 26, 2025

California Highway Patrol, New Year, New Laws, CHP Highlights Public Safety Laws Taking Effect in 2026, December 26, 2025

California Assembly Committee on Transportation, AB 382 (Berman) analysis, hearing date April 21, 2025, on the bill as amended April 7, 2025

Before the next school run

School zones are where California’s speed rules get most local, and they are also where the smallest paperwork problem becomes the most visible one.
